Act 974 of 2021 passed by the 93rd General Assembly requires the Arkansas Attorney General to establish an election law violation hotline and to publish procedures to receive complaints concerning violations of election law.
All complaints filed with the Attorney General shall utilize the form provided by the Attorney General and may be submitted by phone, mail, email, or fax, and may also be submitted online at the Attorney General’s website, www.ArkansasAG.gov. All complaints must contain the complainant’s first and last name, address, telephone number, and email address (if any), and a description of the violation alleged. A complaint must be filed within 30 days after the election that is the subject of the complaint, and must be signed and dated by the complainant affirming that the information provided is true and correct under penalty of perjury. An unsigned, incomplete complaint submitted without all of this information cannot be processed.
The Attorney General will report all complaints received to the Joint Performance Review Committee of the Arkansas General Assembly (JPRC) within forty-five (45) days following the certification of a general election. If the Attorney General believes that immediate action is necessary to address an ongoing election issue, the Attorney General may immediately refer the complaint to the appropriate officials to seek remedy of the issue.
If the Attorney General receives a complaint and finds it is likely that a violation of election law occurred, then the Attorney General may forward the complaint to the appropriate prosecuting attorney, in addition to the JPRC.
Knowingly filing a false claim of a violation of election law is a Class A Misdemeanor punishable under § 7-1-103(c).
